我国自发性体育社会组织的合法性及其发展中的政府职责

Legitimization of Spontaneous Sports Social Organizations and the Governmental Responsibilities during Its Developing in China

近年来,自发性体育社会组织在我国各地大量涌现。从社会合法性、行政合法性、政治合法性、法律合法性等方面对该类组织的合法性问题进行探讨,结果发现:大多数自发性体育社会组织由于其所具有的社会合法性、政治合法性和部分该类组织所具有的行政合法性,使得其发展符合社会的需要,能够对体育公共服务供给形成有益的补充;但绝大部分该类组织是不具有法律合法性的。这决定了政府对自发性体育社会组织发展的"有限放任"管理。基于以上分析,提出了自发性体育社会组织发展中的政府职责:创造良好的发展环境;创新监督管理方式;建立为科学决策服务的相关研究成果的征集与转化机制。

In recent years, spontaneous sports social organizations in China are springing up. We discuss the legitimization problems of this kind of organizations from society, administration, politics and legal. The result showed： because most spontaneous sports social organizations have social legitimacy, political legitimacy, and part of this kind organizations having administration legitimacy, which makes its development to meet society＇s need and to be beneficial to sports public service supplying; but most of this kind of organizations haven＇t legal legitimacy. These makes limited laissez-faire policy of government to manage the sports social organizations. Based on this analysis, we put forward the governmental responsibilities during developing of spontaneous sports social organizations： creating satisfactory developing environment, innovation in supervision and management modes, set up the collection and transformation mechanism of the relevant research results for scientific decision-making.
