Study of the Obligation of Technical Protection Measures Information Disclosure for the Copyright Owner

数字信息技术的快速发展导致技术保护措施的功能已超出各国立法所依赖的技术认识前提。当前版权技术保护措施的运用不仅涉及到信息技术产品的兼容性问题,而且也影响到终端用户的信息隐私,更是关系到计算机网络的信息安全。因此,版权法应转变现行的技术保护措施规制的立法模式,在完善技术措施的保护和例外制度基础上,增加版权人的信息披露义务。

The rapid development of digital information technology has totally changed the functions of technical protection measures （TPM）, which have surpassed the cognition of TPM in legislations around the world. The current use of TPM may affect not only the compatibility of digital products, but also the information privacy of end users. Moreover, the information security of the computer network can also be affected by TPM. Therefore, on the basis of improving the protection and circumventing-exception system of TPM, the legislative model for TPM in current copyright law should be transformed. It is necessary to set up the obligation of the copyright owner to disclose the TPM information.
