当前,我国知识产权纠纷呈现出涉外案件比重大、国际关注度高、案情繁复等特征,建立多元高效的涉外知识产权纠纷解决机制势在必行。"诉调对接"是近几年我国司法实务界提出的新型纠纷解决思路,以结构功能理论为视角,可以发现,建立知识产权纠纷"诉调对接"机制,对于解决涉外知识产权纠纷具有"目的达成、适应、整合和模式维护"等方面的正向推动作用。这一纠纷解决机制的建立与完善,需要从"主体、平台、政策"等多个层面着手。

With the development of the international trade communication, there are more and more foreign-related intellectual property disputes being initiated in Chinese courts. It is necessary to build an effective and multilateral system in order to resolve these disputes. From the dimension of structural functionalism, we can find that if the following three factors, subject, process and policies, are arranged in a scientific way, the new abutment of lawsuit mediation system could help each party of the IPR disputes achieving a win-win situation.
