摘要
数字时代对电影产业的各个方面带来了深远的影响,尤其对电影的制作和传播产生了重大变革。在数字时代背景下,电影的制作手段更加多样化,传播更加便捷,传播范围更加广泛,这为电影产业带来机遇同时,也对电影版权的法律保护带来了新的问题:电影作品的认定、电影作品版权归属及作者身份认定、电影作品在网络传播过程中版权人的信息网络传播权的重构。如何应对这些新问题,是我国《著作权法》第三次修订所要关注的事情。
Digital age has brought the profound influence for all aspects of the film industry, especially on the film creation and distribution. Under the background of the digital era, film production more diversified means, more convenient communication, and wider spread. This is not only the opportunity for the film industry, but also brings new problems to the legal protection for film rights： the cognizance of movie film copyright ownership, identity of the author, and reconstruction of the information network in the process of network film transmission rights holders of the transmission right. How to deal with these new problems is the third revised copyright law has to focus.
