On the Procedure of "Contempt Court" in America

在英美法系诸国,"蔑视法庭罪"在程序法上有着极其显著的特殊性,其不仅是一个简单的罪名,还包含着"法官直判"、"附条件惩罚"、"平行上诉"等一系列特定制度与其相配套。同时,其在类型上可以有直接蔑视、间接蔑视、民事蔑视、刑事蔑视的划分,不同的类型在审理程序、处罚方式以及可上诉性方面各有差异。

In the countries of Anglo- American law system, ＂ contempt of court＂ has significant particularity. It is not only a common accusation, but also contains a series of specific supporting systems like ＂summary sanction＂ , ＂conditional punishment＂ and ＂parallel appeal＂ etc. It can be classified into direct contempt, indirect contempt, civil contempt and criminal contempt. Each of them differs in proceedings, penalties, and appealability.
