英国问题银行特殊处置制度及其借鉴

On the Special Disposal System of UK Failing Banks and its References

近些年来商业银行跨境交易的范围、规模和复杂度不断扩张,本次金融危机证明了原有的银行危机管理制度存在缺陷。金融危机后各主要金融市场国家纷纷启动了立法改革进程,其中英国在2009年通过的银行业法最为系统。目前我国正在加紧制定《银行破产条例》,对英国处置法律体系的考察和借鉴,有助于我国建立完备且适合我国国情的银行处置框架。

For recent years, the scope, scale and complexity of transnational transactions of commercial banks has expanded continuously, the financial crisis proves that there exists defects in the original crisis management system of banking. After the crisis, many major financial market countries started legislative reform process, and UK＇s banking law allowed in 2009 is the most sys- tematic. Presently, we are hurrying to enact the Banking Bankruptcy Ordinance, and make a review and reference of Britain disposal law system, it is beneficial for us to establish a perfect banking disposal framework according to national situation in China.
