摘要
在规制革新的浪潮中行政契约作为传统"命令与控制"手段的替代品获得了越来越广泛的运用。但是行政契约并不仅仅对规制机关与被规制企业产生影响,同时也对第三人也即公众及其环境权益产生影响,因此,行政契约中公众权利的保护乃是一个有待解决的重要课题。为此,必须杜绝"密室契约"现象,在契约的缔结、履行、评估和司法执行中应当遵循公开和公众参与的原则。
Administrative contract is more and more widely used as a substitute for traditional order and control.However,administrative contract has impacts not only on institutions and enterprises but also on the third party,namely the public,and their environmental rights;therefore,the protection of public rights in administrative contract is a critical subject to be solved.Thus,an end must be put to "contract under the table" and the principles of openness and public participation should be followed in the negotiation,implementation,evaluation and execution of contract.
