滇东民族地区农村纠纷行政解决方式调查研究——以罗平县鲁布革乡、富源县古敢乡为例

Investigation of Administrative Solutions to Disputes in Rural Areas of Ethnic Groups in East Yunnan——A Case study of Lubuge in Luoping and Gugan in Fuyuan

作为多元化纠纷解决机制的主要组成部分,行政解决方式能够有效避免司法的先天劣势,也与我国传统乡民普遍较为看重纠纷解决者权力背景的心理契合。针对滇东少数民族地区的实际,在采用行政方式解决纠纷的过程中,应构建"四位一体"的纠纷解决模式,完善公安派出所、乡镇政府的纠纷解决功能,重视民族风俗习惯与制定法的调适。

The administrative solutions to disputes, part of the diverse solution systems to disputes, can a- void the deficiency of justice, which fits well in the power psychological background for the villagers. Facing the facts of many ethnic groups in east Yunnan, the ＂four in one＂ solutions to disputes should be established during the process of taking the administrative solutions to disputes through perfecting the function of the po- lice station and local government and emphasizing the customs and practice of the ethnic groups.
