论中朝婚姻中法理情的冲突与调适——以民族婚姻的属性和公民身份为视角

The Adjustment of Conflict between Law, Customs and Emotional in China and the DPRK Transnational Marriage:Take Marital Property and Citizenship as Example

国际人口迁移中,非正规跨国婚姻及其下一代子女的诞生,极大地挑战了国际移民的管理政策,影响了民间社会的礼俗秩序,牵动着国际社会的情感。文章在重点揭示中朝婚姻属性交织于非法婚姻、事实婚姻与"合法婚姻",朝鲜新娘公民身份交织于非法移民、外国公民与"事实公民"的基础上,进一步从法理情融合的视角,提出调适中朝婚姻的对策,以期对移民管理政策的完善有所裨益。

On the base of international migration, cross-border marriage established through non-formal means can impact remarkably international migration management, the social order and the emotional of society. So, pay more attention to the marital property and citizenship, focus on why there are involved in illegal marriage, fact marriage and regular marriage; illegal immigrants, foreign citizen and citizen. On the basis of these, puts forward some measures for adjustment to marriage and the immigration management policy.
