新出唐胡演墓誌與初唐司法政務

Research on the Epitaph of Hu Yan and the Operation Mechanism of Judiciary Affairs in Early Tang Dynasty

唐胡演墓誌是一方新出唐人墓誌。誌主胡演是初唐司法官員,先後出任大理少卿和刑部侍郎。但兩《唐書》未予立傳。墓誌提供了關於胡演及其家世更爲詳細的信息,可與《資治通鑑》、《元和姓纂》等傳統史籍比勘。本文對胡演的生平作了考釋,又對唐初十二軍制以及司法政務運行所涉及的唐代囚帳管理、參與死刑覆議的兩省官員範圍進行了討論。

This thesis researches the epitaph of Hu Yan, an official successively acting as Dali shaoqing( 大理少卿) and Xingbu shilang( 刑部侍郎) in early Tang. Yet there was no biography of him in Jiutangshu( 《舊唐書》) or Xintangshu( 《新唐書》). According to the epitaph,the thesis discusses many details about Hu Yan,such as his ancestors,family,and his experience. Then the author studies the operation mechanism of judiciary affairs in early Tang,focusing on two topics: one is the administration of Qiuzhang( 囚帳),and the other is the officials consisting of Zhongshu Sheng( 中書省) and Menxia Sheng( 門下省),who were ordered to discuss the accuracy of death penalty cases which had been sentenced by local governments and other agencies,such as Dalisi( 大理寺) and so on.
