Exploration of technical investigation provisions in new Criminal Procedure Law

新刑诉法将呼吁多年的技术侦查合法化,标志着我国法治进入一个崭新的时代。同时,由于我国的技术侦查立法刚起步,技术侦查条文过于概括化,缺乏可操作性。本文试着对技术侦查条文进行分析,并提出完善建议。

The new Criminal Procedure Law legalized thetechnical investi- gation that has been appealed many years, marking China＇s rule of law into a new era. Because the legis lation of ＇ technical investigation has just started, the clauses of technical investigation are too general and lack of maneuverability. This paper tries to analyze the provisions of technical investigation and make sug- gestions for improvement.
