On System Justice and Its Responsibility Subject

正义是制度之魂,制度正义不仅表现为社会主体的利益均衡与协调,而且表现为公民个人自由、机会、平等、尊严等权利的维护。正义制度对社会进步发挥着十分重要的作用,但制度正义不是自然而然实现的。政府是制度正义的责任主体,制度正义的实现必须依靠政府来推动。政府推动制度正义建设的具体途径有:政府立法要以公共利益最大化为价值取向;政府要以民生为本进行制度设计;政府的政策制定要推动道德进步。

Justice is the soul of a system, system justice is embodied not only as the benefit of balance and harmony of social subjects, but also the maintenance of civilian＇s personal rights of freedom, opportunity, equality and esteem. System justice plays a great role in the process of social progress, but it cannot be implemented automatically and naturally. The government is the responsibility subject of system justice, which means that the realization of system justice must be advanced by the government. The ways that the gov- ernment advances the development of system justice lies in the following： the governmental legislature must be orientated by the value of the maximum of public benefit, the government should design system with the focus on the livelihood, the making of the government policies can develop the moral progress.
