摘要
解雇保护制度在我国劳动法制体系中占据着重要地位。劳资利益的衡平与劳动者权益的维护是解雇保护制度的立法着眼点。通过对若干典型解雇纠纷案件的实证分析,发现我国解雇保护的相关立法规定仍存在一定的原则性和粗线条性,解雇保护的司法救济存在适用利益衡量原则的必要性。为防止利益衡量原则成为恣意适用法律、超越规范的任意行为,法官应在遵循必要的规范和程序的基础上,在利益冲突的格局中实现各个利益主体之间的权益衡平,以弥补立法的缺漏,最终实现个案的实质正义与社会的公平稳定。
Dismissal protection system occupies an important position in the labor legal system in China. The legislative focus of dismissal protection system is the equity of interests between Employers - employees and the maintenance of labor rights. Through empirical analysis of several typical dismissal disputes, find the dismissal protection legislation provisions are still broad -brush, it is necessary to use the interest balance principle on the precess of ju- dicial remedy of dismissal protection. To prevent the principle from willful law and beyond the legal norms, Judges should follow the norms and prece- dures, achieve the balance of the interests between the various stakeholders, make up for the omission of legislation, achieve substantive justice and social fairness and stability ultimately.
