医改梦想:以较低支出实现民众医疗普遍保障——英国的法治化实践与启示

Healthcare Reform Dream:To Achieve Universal Healthcare with Lower Spending——The Practices of Rule of Law in the UK and its Implication for China

英国国家卫生服务(NHS)能以较低的卫生支出为全民提供免费(基本)医疗卫生服务,以促进社会平等为己任,实现了人类的梦想。其成功的"秘诀"至少有六,即总额预付制度、NHS合同制度、NICE的标准和机制、均等性的法律机制、社区保健与初级保健制度和公众卫生参与制度。所有这些制度,都可以从《国家卫生服务法》或配套法律中找到依据,并得到了良好的执行。这提示政策导向的中国新医改必须在法治化道路上进行探索。

There are at least six ＇secrets＇ for British＇s success in providing flee healthcare with lower spending to all people legitimately living in the UK under National Health Service （NHS） which is the dream of human being： the total amount of pre-paid system, the NHS contract system, NICE standards and mechanisms, legal mechanisms of resource equalization, community and primary healthcare system, and public health involvement system. All of these systems are established on the basis of the National Health Service Act and other relevant medical laws, and more importantly, they have been performed well. This suggests that the road to rule of law should be followed by the policy-driven healthcare reform in China.
