摘要
由于夫妻共有房产单方抵押的效力问题至今仍然为比较难以解决的问题,在处理相关效力问题的案件时,应当充分考虑夫妻双方是否实为知情,并了解交易方是否为善意第三人,并已履行相应的关注义务。文章通过对建立不动产善意取得制度进行具体分析。
