论抗辩式教学在法学教育中的运用

摘要 现有的经院式教学模式有助于法学知识系统化地传递,但是其固有的弊端是过于关注抽象知识体系的传授而不利于调动学生的主动性和实践能力的提高,且评价标准过于单一。抗辩式教学则侧重于向学生传授如何运用法律知识的实践技能,能够提高学生理解和运用知识的能力。作为经院式教学模式的有益补充,抗辩式教学可以通过开设专门的抗辩课程或在传统课堂教学中引入抗辩方法来展开。 Current Scholastic Teaching is conducive to systematically passing on the legal knowledge, however the innate flaws are that it puts much emphasis on transmitting the abstract intellectual system instead of promoting the initiative and practical skills of students, and the evaluation standard is also too unitary. On the contrary, the Counterpleading Teaching focuses on how to help students master the practical skills of legal knowledge and also enhance students' capacities to grasp and utilize these knowledge. As an useful supplement to Scholastic Teaching, Counterpleading Teaching can be conducted by setting up specialized counterpleading course or introducing counterpleading method to traditional class teachings.
