基于市场化导向的我国专利政策功能定位研究

Study on the Functional Orientation of Patent Policy Based on Marketization

为了揭示专利政策运行的现状及其对我国专利市场化的影响及政策改革方向,本文通过对我国相关政策进行搜集、分析和整理,归纳了这些政策的总体特征和变化趋势,并分别从专利申请、专利维持和专利实施三个方面分析了我国专利市场化的总体特征。本文的研究表明:在我国,专利市场化受到政府政策的推动,政府主导性特征明显;我国现行的政策主要集中在推动专利申请量的增长方面,专利实施和维持率较低。基于此,本文提出我国专利政策功能定位改革的方向:弱化专利政策对专利市场化的干预,强化市场驱动的作用;强化专利政策改善专利市场化环境的功能。

In order to reveal the impact of patent policies on patent marketization and the direction of policy reform,this paper,through collecting,analyzing and tidying the policies related to China＇s patents,generalizes characteristics of these patent policies and change trend.Then,it explicates general feature of China＇s patent marketization through three aspects of patent＇s application,maintenance and implementation,showing that China＇s patent marketization is government-oriented and China＇s current patent policies are mainly focused on motivating the growth of the amount of patent application,but less on patent implementation and maintenance.On the basis of these reasons,this paper provides two measures： to weaken the direct effects from patent policies to patent marketization and enforce the function of market driving;to enforce patent polices and improve the market environment of patent marketization.
