美国法律适用中“回家去的趋势”及我国法律适用中的法院地法倾向

The Trend of “Going Home”in the Application of Law in the United States and the Trend of Les Fori in the Application of Law in China

法院地法是国际私法中一个重要的系属公式。内国法院在审理涉外民商事案件时,适用法院地法是一种固有的倾向。美国冲突法革命期间,法院地法倾向进一步扩大,出现一种被称之为"回家去的趋势"的现象。我国法院在审理涉外民商事案件时,法院地法的适用占据了绝对的比例。2010年《涉外民事关系法律适用法》的颁布实施对合理限制我国法院地法倾向扩大化具有积极意义,同时也依然存在一些不足。

Les fori （the law of court） is an important formula of attribution in the international private law. In the trial of foreign-related civil and commercial cases in the foreign countries, the application of les fori is an inherent tendency. During the revolution of American conflicts law,lesfori tended to expand and there appeared a phenomenon called the trend of ＂going home＂. In the trial of foreign-related civil and commercial cases in China,les fori occupies absolute proportion. In 2010, the Law of Application of Law for Foreign-related Civil Relationship was promulgated and implemented, which was of great positive significance for reasonable restric-tions to the spread of tend of les fori in our country. But at the same time, it still has some shortages.
