摘要
获得适当治疗是精神障碍者在强制住院期间应享有的基本权利之一。在美国,直到20世纪60年代精神障碍者的治疗权才引起理论和司法实践的重视,其中具有代表性的判例是Wyatt v.Stickney案。该案明确将治疗权视为非自愿拘禁患者应享有的宪法权利之一,州政府及精神卫生机构有义务采取措施保障住院精神病人治疗权的实现,并达到法院所确立的最低限度的条件和标准。Wyatt案对我国法律界具有重大启示意义。
The treatment right is generally viewed as one of the fundamental rights of involuntarily hospitalized persons with a mental illness. In the United States, the treatment right for mental disorders got the attention of theoretical and judicial practice till the 1960s, with Wyatt v. Stiekney case as one of the typical ones, in which the court ruled that involuntary hospitalized patients have a constitutional right to receive treatment, and the State governments and mental health institutions have an obligation to take measures to ensure the implementation of the treatment right of involuntarily hospitalized patients, and achieve the minimum requirements and standards established by the courts. Consequently, the case of Wyatt v. Stickney has great significance to legal field in China.
