从人体器官黑市交易探讨我国器官移植法律的完善

A Probe into the Improvement of Organ Transplantation Law in China by Investigating Black Market Trade of Human Organs

人体器官移植已经成为了拯救人类生命的重要手段之一,随着我国医疗水平的不断提高,器官移植事业也得到迅速发展。然而面对巨大的人体器官供需缺口,器官黑市交易活动也日渐猖獗。本文首先分析阐述了我国人体器官黑市交易产生的原因;接着指出器官黑市交易损害了人的生命自主权和健康权,并且违背了公序良俗原则;最后结合我国国情并从比较法的角度,探索并提出了关于完善我国器官移植立法的一些思考。

Human organ transplantation has already been one of the most efficient methods to save human beings＂ lives. The development of medical treatment in China leads to more and more organ transplantations. However, for the sake of a huge shortage of organ supply, there is an explosive expansion of the black market trade of human organs. In this paper, the author analyzes and states the reasons of black market trade of human organs in our country, then points out that black market trade does harm to people＇s autonomy right to life and health, violates the principle of public order and good social customs, finally explores and puts forward some thinking on perfecting organ transplant legislation from the perspective of comparative law in China by combining with China＇s national conditions.
