“Institutional Anti-corruption”Should Guard Against“Institutional Corruption”——From the Perspective of Institutional Construction in Colleges and Universities

制度反腐"须谨防"制度腐败"。制度腐败主要表现为:制度制定的走过场、制度执行的多变性、制度解释的随意性、制度内容的非良性。防范制度腐败要注意做好三个方面的工作:第一,加强法治宣传教育,提高民众法治意识,破除制度工具性理念,树立制度保障性理念。第二,实行基本制度的议行分立,严格制度制定的程序规范;实行执行制度的部门责任制,加强制度执行的民主监督。第三,进一步完善制度,确保制度的良好性;尽量细化制度,减少制度执行的自由空间和解释的任意空间。

“Institutional anti-corruption”should guard against“institutional corruption”. Institutional corruption is mainly em-bodied in the following aspects: they are established in a perfunctory way, carried out inconstantly, explained randomly and filled with negative contents. To avoid institutional corruption, the following work should be completed. First, we should strengthen propagation and education of the conception of rule of laws, raise the general awareness of rule of laws, break down the impression of using institutions as an instrument and set up the idea of institutional indemnification. Second, we should im-plement the separation of basic institution’s decision and execution, stiffen the procedure norms of system making, and strengthen democratic supervision of execution. Third, we should perfect the institutions and ensure their fairness, elaborate the institutions to the greatest extent and pay attention to the discretion of execution and interpretation.
