摘要
法律职业共同体不同于法律人和法律人阶层的概念,它们在内容、形成及演变等方面存在着差别。法律职业共同体是达到了一定组织化程度的概念,具有专业性、公共性、自治性、流动性的特征。厘清转型社会中法律职业共同体的概念和理论基础,有助于推动我国处于转型时期的法律职业化进程,创造更为良好的司法环境,达到更好的社会效果。
Legal professional community, different from legal lawyers and legal professional stratum in terms of contents, constit- uent and development, is a conceptual formation featured by professionalism, publicity, autonomy and fluidity. Clarifying the concept and theoretical basis of legal professional community may contribute to China＇s legal professionalization in the transi- tional period and help to create a better judicial circumstance for preferable social effect.
