当前形势下的我国法医司法鉴定投诉问题思考

近年来,我国法医司法鉴定的信访投诉呈逐年上升趋势,已严重干扰到法医司法鉴定的公正性,制约了鉴定工作的顺利开展。当前形势下法医司法鉴定信访投诉量大幅上升,投诉涉及范围扩大,且恶意投诉增多。究其原因,投诉人是希望通过投诉改变鉴定结果。而司法鉴定监督制度欠完善,鉴定机构管理欠规范,鉴定人法治观念淡薄、素质良莠不齐以及鉴定人合法权益保护机制的建立滞后等原因,均是造成当前鉴定投诉问题不断增多的根源。为控制和避免司法鉴定投诉问题的发生,应完善司法鉴定监督管理制度,加强鉴定机构的规范化,提升司法鉴定人法律素养,加强法治和职业道德教育,严肃查处法医司法鉴定中的违法、违纪问题,建立鉴定机构优胜劣汰机制,以确保鉴定人的合法权利。

In recent years, the rise in forensic petition complaints has increasing influence on the impartiality of forensic identification work. The volume of forensic petition complaints enlarges substantially, and it involves more extensive aspects, malicious complaints are increasing, which can be justified for the patients＇ motivation to change the identification results by complaints. The root causes of increasing forensic complaints are incomplete forensic identification supervision system, the irregular management of the forensic agencies, weak legal conception of forensic appraisers and poor protection mechanism of legitimate rights and interests for forensic appraisers. To decrease and avoid judicial identification complaints, it is recommended to improve the judicial identification supervision and management system, strengthen the standardization of forensic identification agencies, enhance the judicial knowledge and occupational moral education for forensic experts, check as well as deal with il- legal behaviors and establish the mechanism to sort out the quality appraisers.
