我国宅基地使用权流转法律问题探析

当前我国农村宅基地使用权流转中存在的主要问题是法律法规的不完善且滞后,宅基地的管理比较混乱,宅基地使用权流转的隐形交易屡禁不止等。对此,我国应尽快修改相关法律法规并制定专门的宅基地使用权流转法规,明晰宅基地使用权登记制度,建立规范的宅基地使用权流转条件和模式等。

The main problem of the use of right of transferring in the current rural land in the presence is of imperfect laws and regulations and lag behind, the homestead management is chaotic, the invisible transactions of the use of right of transferring in homestead despite repeated prohibition. Therefore, our country should amend the relevant laws and regulations as soon as possibly, make special land use right transfering regulations, clear the registration system of the use of right of transferring in homestead, and establish the standard of the land use right transfering condition and mode etc.
