政府管控与高校办学自主关系探讨——以西北政法大学“申博”复议案为例

Exploring on the Relationship between Government Control and University Autonomy in School-running——A Case of NWUPL's Application for the Qualification of Conferring Doctoral Degree

高校的发展是利益相关者(市场、政府等)的利益诉求推动的结果,各方面协同一致的合力使得高校取得长足发展。文章以西北政法大学"申博"复议案为例,探讨了政府与高校的关系,分析了行政决策效度不够、专家作用过强、国家与地方权责不对等、行政概念相冲突、地方与学校协同统一性不强、对高校的评估不规范等问题,并从立法、行政、司法三个角度提出了看法。

The stakeholders＇（e.g.,the market,government） interest demands promoting the development of colleges and universities,and the joint effect from all aspects can help colleges and universities to achieve the long-term development.This paper takes the Northwest University of Politics and Laws（NWUPL） case as an example,analyzing four problems embedding in the case university.Firstly,the effectiveness of the administrative power of the government is not strong enough,whereas the experts have very strong power;secondly,the rights and responsibilities do not match between the central and the local,therefore,there are some conflicts in terms of administrative power between them;thirdly,the incompatible development between the local and colleges and universities;and finally,the evaluation for colleges and universities are not standardized.It ends with some suggestions focusing on legislative,executive,and judicial issues.
