摘要
婚姻法司法解释(三)对于夫妻离婚时财产归属的规定可谓一石激起千层浪,遭到许多的质疑,特别是女性主义法学者的强烈反对。回顾古代"同居共财"家产制,探析当下婚姻法司法解释(三),其虽彰显了法律的平等精神和推动了法律程序理性化的进程,但同时加速了传统家庭观念的瓦解和加深了民众对法律的信仰危机。未来的夫妻财产制建构,既要关注社会性别差异与男女平等的良性互动,又要重视传统家庭伦理观的借鉴价值。
The Interpretation（ the 3rd） of the Marriage Law for the marital property division has met up with lots of ques- tions, esp. with the strong opposition of feminist legal scholars. Reviewing the ancient marital property system of cohabitation common wealth, the interpretation shows the legal spirit of equality, and has promoted the rational process of proceedings, but it has accelerated the disintegration of the traditional family values and has deepen people＇ s crisis of faith in law. Future matrimonial property system construction, should not only lay attention on the positive interaction of gender differences and e- quality between men and women, but attach importance to the reference value of traditional family ethics.
