论取得时效制度价值及我国的立法构建

The Value of Acquisitive Prescription System and the Legislation of the System in China

随着市场经济的发展,建立完备的取得时效制度是十分必要和迫切的。我国关于此项制度是否建立一直处于理论界的争议之中,并未立法。从其秩序、效率、公平这三个价值方面对取得时效制度在我国建立的必要性研究发现,目前我国在财产的事实状态与法律状态上仍存在严重脱节、权利的归属混乱等问题。通过立法构建取得时效制度,应在其构成要件、适用范围的两方面进行,以建立起完备的取得时效制度,促进社会稳定和经济发展。

The development of the market economy has made the establishment of a complete acquisitive prescription system necessary and urgent. Whether to build the system or not in China is still unsettled among researchers without legislation. Necessity research of_ building the acquisitive prescription system in China is conducted with respects to three values in terms of order, efficiency, and fairness.It is found that in China the actual property condition is usually seriously discrepant from the legal property condition and right owne^hip is chaotic. The legislation of acquisitive prescription system should be focused on its key component and scope of application for accelerating the social stability and economic development.
