论消防行政执法违法责任的追究

A Discussion of the Illegal Responsibility Investigation of Administration Enforcement in Fire Protection

消防行政执法违法行为不仅侵犯了消防行政相对人的合法权益,对我国消防行政法治建设也产生了不利影响。从消防行政执法违法责任的概念以及追究的必要性、应遵循的原则和追究实施四个方面进行论述,提出在消防行政执法违法追究中应做到"合法"、"合理"。

Illegal behavior of the administration enforcement in fire protection not only violates the legitimate rights and interests of a person related, and also has a negative effect on the fire administrative law construction in China. This paper discusses the conception, the necessity, the principle and the implementation of the illegal responsibility investigation of administration enforcement in fire protection, and puts forward some view for how to investigate and affix the responsibility legally and reasonability.
