On the Legal Definition of Medical Fault

医疗过失作为医疗侵权责任的构成要件之一,在医疗侵权损害赔偿理论及医疗审判实务工作中非常重要。但是对于医疗过失的概念及其本质等基本问题,理论界及实务界存在有一些争议。文章考察了国内外对医疗过失的认识过程,在对比侵权理论中过失基本概念基础上,阐述了医疗过失的本质等问题,以期对医疗过失的相关理论研究及实务中认定医疗过失有所帮助。

As a component of medical tort responsibilities, medical fault is important in the theories and trial practice on medical tort harm compensations. However, disputes exist on the definition and nature of medical fault. Based on domestic and international medical fault recognition as well as a comparison of basic concepts concerning tort theories, this paper illustrates the nature of medical tort so that it can shed light on the theoretical research and practice involved.
