我国运动员成绩的产权界定

Definition of the Ownership Right of Athletes’ Achievement in China

通过理论分析 ,论述了运动员竞技能力或运动成绩的所有权归运动员所有。在我国社会主义市场经济条件下 ,运动成绩的产权按权能分离结构运行 ,各权能行为主体行使自己的权力。在产权交换时 ,各行为主体享有受益权 ,并通过占有权获得权利。鉴于我国体育竞赛的产权现状 ,应尽快制定有关法规 ,保护运动员和有关行为主体的权益 ,推动我国体育产业健康发展。

Athletes’ achievement is the most valuable factor in top level sports. Along with the development of sports industry in China, unclearness of the ownership right of athletes’ achievement has become an obvious problem in sports talents transfer market, which seriously influenced the exchange and transfer of athletes. It is discussed based on theoretical analysis that the ownership right of athletes’ athletic ability and achievement should belong to the athletes themselves. But under the present condition of socialist market economy, the ownership right of achievement should be divided as the right and the athletic ability which are separately controlled by their different action subjects. When the property right is under exchange, different action subjects enjoy their right of benefit and gain interests through the right of possession. It is suggested that rules and regulations concerned should be promulgated sooner to protect the rights and interests of athletes and relevant action subjects, so that to promote a proper development of sports industry in China.
