摘要
目前 ,由于我国在体育课伤害事故方面尚未立法 ,对于发生在体育课中的伤害事故难以恰当地处理 ,致使有些学校为避免学生在体育课教学和课外体育活动中发生伤害事故 ,甚至禁止学生开展某些项目的体育活动 ,从而影响了学生的身心健康 ,不符合体育法的有关规定。本文试图对体育课教学和课外体育活动中伤害事故的种类、归责原则、法律处理等方面的问题进行初步探讨 ,以期引起人们的重视。
most or physical education injuries in our country can't be handled correctly due to the imperfection in the relative legislation.To avoid the physical education hurts. Some schools even stop the students from some physical education items. And this has not only greatly affected the students' physical and mental healthy growth, but also violated the relative provisions of physical education. This article gives an overall analysis and research on some aspects of physical education hurt, such as its kinds, principles of responsibility and legal settlement.
