政府主导和主持行政处罚听证、行政许可听证、价格决策听证及行政立法听证,是政府应提供的法律服务之公共产品,政府通过购买法律服务,由律师主持行政听证,是公共权力让渡的合同出租,是个全新的课题,此类合同出租如何运作,其流程是什么,应怎样予以规制,都需要探索和研究。
The author discusses in this article the operating procedure and regulation of the government pur-chased legal services contract outsourcing for the administrative hearings which are meant to be presided over by lawyers.
