摘要
市场中沿用的我国《合同法》第229条关于"买卖不破租赁"的规定,将保护的天平更多地倾向于承租人的利益,有忽视甚至侵害租赁物新所有权人利益之嫌,不利于建立安全便捷的租赁市场交易环境。国家应当以租赁物新所有权人的恶意为兜底条款,并且区分中短期租赁与长期租赁的不同情形分别补充规定"买卖不破租赁"的适用条件。
The 229th article on "Not Breaking the Sale of Lease" in "Contract Law" in China is more inclined to protect the interests of lessee, and to some extent ignores and even damages the interests of lease holds of own- ers, which is not conducive to the establishment of a safe and convenient transaction environment of leasing mar- ket. In the law, the malice of lease holds of owners should be regarded as miscellaneous provision. According to the different situations in short and medium term release and in the long-term release, some applied provisions should be added up to the article 229th on "Not Breaking the Sale of Lease".
