摘要
"冲突规范是什么性质的法律规范"这一问题在国际私法学上素有争议,而问题的实质在于中国法理学对该类规范尚未有充分的认识和研究。实际上,在法律规范体系中存在着一类适用法规范,我们可以对它作如下定义:凡是对法律适用行为本身作出指引的规范,都属于适用法规范。适用法规范不仅包含冲突规范,也有其它多种表现形态,在各类法律文件中都有体现。适用法规范是一种行为规范,也是裁判规范和技术性规范。在法律规范体系中,适用法规范虽然数量不多,却对于整个法律规范体系的运作有着不可缺失的作用。
The problem of'what is the nature of conflict rules'has many arguments in science of private international law,but the key of the problem is absence of enough understanding and study to this kind of norm in Chinese jurisprudence. Actually,there are some legal norms of application in legal norm system. We can define it as: all the norms which direct the action itself of legal application are legal norms of application. Legal norms of application not only include conflict rules,but also in- clude some other kinds of legal norms in legal documents. Legal norm of application is a kind of behavior norm,juridical norm and technical norm. Although the amount of the legal norm of application is not so many,they perform an important function that can not be replaced in enforcement of whole norm system.
