Research on the Sexual Rights of Persons with Mental Retardation from Human Rights Perspective

性权利是一项新兴权利,包含性自由权、性自主权、性教育权等。作为社会人,智障者同样也拥有这些权利.智障者性权利的基础是性生理、性心理、情感等方面的需要。智障者性权利实现的主要障碍是社会公众对智障者性权利认识不足及智障者在现实生活中的自身能力不足。智障者性权利最终实现需要从改变社会公众的认识和支持体系入手。

Sexual right, as a newly emerging fight, covers the rights of sexual freedom, sexual autonomy and sexual education. Being a member of the society, the persons with mental retardation should equally enjoy those sexual rights. The sexual rights is based on the mental retardation＇s sexual needs from physiology and psychology, as well as their requirements for emotional attention. The main obstacle which blocks the mental retardation to enjoy their sexual tights is the absence of public awareness of mental retardation＇s sexual rights. Meanwhile, people with mental retardation are relatively lack of ability and may also turn into a hamper. In a word, only if the public awareness of mental retardation＇s sexual rights starts to rise and the social support systems are improved could the mental retardation＇s sexual rights be achieved.
