论证据规则在国际体育仲裁院(CAS)仲裁程序中的运用

The Use of the Rules of Evidence in Arbitration Proceedings of CAS

证据规则是指规范证据的收集、审查和评价等诉讼证明活动的准则,包含形式规则和实体规则两个方面。在CAS仲裁中不存在着严格的、正式的证据规则,但仲裁员在处理体育争议的过程中,对于证据形式采纳及在举证、采证认证的过程中仍需遵守相应的证据规则。

The rules of evidence refers to the activities that standard of evidence collection, review and evaluation pro- cedure guidelines, contains two aspects： formal and substantive rules. In the CAS arbitration rules of formal evidence does not exist, but strictly, the arbitrator in the process of sports dispute, evidence for process adopted and certifica- tion in the burden of proof, the need to comply with the relevant rules of evidence.
