权力结构与公民参与视域下的中国陪审制度

Chinese Jury System under the Horizon of Power Structure and Citizen Participation

分析中国陪审制度的历史和现状,总结出中国陪审制度具有陪审员遴选范围狭窄、陪审员权力受限、职业化培训不足和案多人少等特征。从权力结构和公民参与的视角,上述特征产生的原因是司法政策导向、司法权力制约、相关制度欠缺和"无讼"的传统诉讼文化。想要真正实现陪审制度的作用,必然要调整国家权力和公民参与之间的关系,一定程度限制公权力的扩张和保障公民积极参与。

This paper analyzed the history and status of jury system in China. It can be summed up that China＇ s jury system has the characteristics of narrow jurors＇ selection scope, limited power, pro- fessional training and the function of complement the court. From the angle of power structure and cit- izen participation, the causes of the above features are the judicial policy guidance, the judicial power restriction, lack of related system and traditional litigation culture. To realize the role of the jury sys- tem, we must adjust the relationship between the state power and citizen participation, to some extent restrict the expansion of the public power and guarantee citizen participation.
