摘要
一片土地适合生长什么,取决于是何种土壤。在当今法治社会背景下,我们努力探索侦查制度改革创新的路径,往往从西方的侦查制度中去寻找良方,却忽略了制度本身存在的历史渊源与时空环境。与其瞻仰眺望别国制度之先进,不如立足本国,回溯和审视历史,总结成就与弊病,通过分析我国古代侦查体制和方法的特点和对后世的影响,来重新解读和评价我国当前的侦查制度。
In our rule of law society we are trying to research the way to reform and innovate our investigation system based on Western countries’ investigation system,neglecting its own history and environment.The system should be based on our own country,looking back and examining the history concluding achievements and drawbacks.Our present investigation system can be reread and evaluated by analyzing the characteristics and effects of ancient investigation system and its approach.
