我国“专利沉睡”之困与治理研究

在回顾了以往研究文献基础上,始于专利产生实施所涉及的利益主体视角,从主体利益差异、政府过度干预、专利产生机制与知识产权保护不力、估值机构缺失与"信息不对称"等多个角度对"专利沉睡"产生的原因进行探讨,针对存在的问题提出了治理"专利沉睡"、提高科技成果转化率的几条途径,具有一定的理论意义与实践意义。

In this paper,based on the literatures reviewed, began in the patent produce implementation involves the in- terests of the main body Angle, we discusses the cause of patent of ＂sleeping＂ from the main body benefit difference, exces- sive government intervention, the generation mechanism and lack of protection of intellectual property, patent valuation in- stitutions lack and the ~＇information asymmetry＂ and so on , aiming at the problems existing in the patent of ＂sleeping＂ management, provide several of the way to increase the conversion rate of scientific and technological achievements, has certain theoretical significance and practical significance.
