On Public Participation in Legal System Construction of Government Information Disclosure

信息公开法制建设与扩大公民有序参与互为表里、相互作用,已经成为中国民主法治建设中密切关联,又相互包容、相互支持的两项重要内容。中国公众对信息公开法制建设的参与,主要有普通民众的个人或群体参与、专业人士和社会组织的参与以及学术界的参与。考察分析近年,特别是2011年度的中国公众参与信息公开法制建设的实证资料,可见公众参与体现了信息公开法制建设的内在要求,为其提供了不竭的动力来源,也为政府规制信息行为提供了正当性支持,促进了尊重和保护基本人权要求的落实。同时,其显现出参与主体日益专业化、组织化和群体化;参与方式日益多样,参与途径不断拓宽;社会影响和实效不断增强;新闻媒体和包括博客、微博在内的网络新媒体在其中发挥至关重要作用等特点和发展趋势。

Public participation in legal system construction of government information disclosure has be- come a highlight of Chinag human rights protection practice. The subjects of public participation include indi- viduals or groups of ordinary people to participate, professionals, social organizations and academia. Public participation reflects the inherent requirements of legal system construction, which provides an inexhaustible power source, and also regulation of government information with legitimacy, implementing the respect and protection of fundamental human rights requirements.
