离婚救济制度的法经济学分析

The Divorce Remedy System from the Perspectives of Law and Economics

保护婚姻投资对深化家庭分工、增进婚姻收益以及降低离婚率都具有重要作用。我国现行离婚救济系列制度——破碎主义原则、财产分割、经济帮助、经济补偿等——对婚姻投资保护不足,过低的离婚成本在客观上刺激离婚率节节攀升,因此,必须引入信赖利益赔偿机制,并结合别居制度进一步增加离婚成本。

The protection of marital investment plays an important role in deepening division of family labor, increasing the marriage benefits and reducing divorce rate. The current divorce remedy system is inadequate for protecting marital investment, and it imposes too low divorce cost on divorce parties and stimulates objectively the rise of divorce rate. We should introduce the machanism of compensation of reliance interest and separation system to further increase the cost of divorce.
