摘要
分析了侵权债权人保护的实践和法律困难,并对如何更好地保护侵权债权人的合法权益作了探讨,认为设立"行业互保协会基金"、建立企业责任强制保险制度、修改相关立法、设立"优先担保权"制度是当前可行的选择。
In recent years, because of the imperfection of law, the tort creditors cannot gain compensation in time in the tort incidents made by enterprises. This article researches how to protect the tort creditors. It suggests that we should set up Industry Self--help Fund, and perfect legal system by constructing system of Industry Compulsory Insurance and Property Lien.
