论我国专利被许可项目融资担保制度之构建

专利被许可项目融资担保旨在解决被许可人引进他人专利的资金短缺问题,同时也是保障资金供给者的交易安全而形成的一种融资担保方式。中小企业经济发展方式转变的唯一出路就是被许可使用他人的专利,然而在我国现有的法律体系当中,没有关于专利权被许可人融资和资金供给者交易安全的规定。因此,有必要对项目融资担保以及专利被许可项目融资的具体担保制度进行研究,以促进我国的专利被许可项目融资担保法律制度的构建和完善。
