我国行政复议关键制度的科学变革

The Scientific Revolution of Administrative Reconsideration Key System in China

行政复议制度实施以来,有效解决了行政权与公民权的冲突,维护了当事人合法权益。但仍存在大量的制度性缺陷,难以适应中国推进民主法治和建设市场经济的现实需求。论文在我国行政复议的性质与价值取向、构建权威而又中立的复议决策系统、确立多样化的行政复议审查方式、建立我国行政复议行为的监督机制等几个关键制度上进行阐述,意在科学变革我国的行政复议制度。

Since the implementation of the administrative reconsideration system,to effectively solve the conflict between administrative power and civil fights,safeguarding the legitimate rights and interests of the par- ties.But there are still many defects in the system,It is difficult to adapt to the practical needs of China to promote democracy and the rule of law and the construction of market economy.Based on the nature and the value orien- tation of ChinaPs administrative reconsideration,The reconsideration decision system of authority and neutrality,the establishment of diverse administrative reconsideration review,several key system to establish the administrative reconsideration of ChinaPs supervision mechanism are discussed,to the scientific revolution of Chinese administra- tive reconsideration system.
