摘要
当前,人民法院受理的物业费纠纷案件逐年递增。司法实践中物业费纠纷的审理存在三大难题,即传唤难、调解难、执行难。要走出物业费案件审理的困境,一方面,要针对具体问题采取相应的治标之策,缓解传唤难,改善调解难,继而才能攻克执行难;另一方面,也要跳出个案从源头进行治理,即在纠纷的萌发、产生、碰撞以至化解甚至后期的预防等各个阶段加入司法干预,搭建起"社区审务平台",唯有如此,物业服务纠纷的化解才可能从治标向治本迈进。
Nowadays, disputes about property management fee increase with each passing year. In ju ridical practice, there are three major challenges in the processing of these cases, which include low call and occurrence rate, difficult mediation and poor execution. To meet these challenges and find the best solution, on one hand, we are to take effective measures with regard to particular cases, improving call and occurrence rate, enhancing mediation, then finding solutions to inefficient execution. On the other hand, it is demanded to put judicial intervention into every link from the very beginning to the climax and the resolving of a dispute, even the prevention of later period. Accordingly judicial affair platform in community is to be constructed. Only in this way, solutions to the disputes about property management fee will step from symptom treats to permanent cures.
