城市拆迁中的合谋问题及解决机制研究

A Study on the Collusion and Settlement Mechanism in Urban Demolitions of Houses and Relocation

本文结合案例分析法对城市拆迁中的合谋及其主要形式进行了解析,在对利益主体进行理性"经济人"假设的前提下演绎城市拆迁中政企合谋的产生并探索其形成的内在机理;并在此基础上引用合谋与防合谋理论,进行城市拆迁防合谋监管机制的设计。

Based on case analysis, this paper analysed the problem and the main forms of the collusion in urban demolition of houses, then deduced the emergence of collusion between the government and enterprises from the premise that all the interest subjects are the rational ＂economic man＂. The paper also explored inherent mechanism of the formation of collu- sion. Finally, using collusion theory and collusion prevention theory, the supervision mechanism of collusion prevention in urban demolition of houses was designed.
