The Safety Perspective of the Industry:A Comparison of the Policy of Retail Industry in China and in the West

基于产业安全视角,对中西零售业政策进行比较研究。运用综合类比法,定性分析法,对建立与完善我国零售产业保护制度提出相应的对策。将零售产业安全风险防范作为零售市场规划设计的主要制度安排;将完善市场经济条件下的国内零售业立法作为其制度保障;确立商业惯例与商业协会的法律地位,提升其机制屏障。

Based on the safety perspective of the industry, this paper makes a comparison of the policy of the retail enterprise in China and the west. Using research methods such as comprehensive analogy and qualitative analysis, it proposes some relevant policies in establishing and bettering the protection system of the retail industry in China. The paper also suggests the safety precaution of the retail industry should taken as a system in the overall planning of the retain market, the formulated law of the retail industry in the condition of bettering market economy should be taken as its guarantee for this system and the legal position of the business convention and the business association should be established to elevate its structural screening.
