摘要
日本刑事诉讼程序在构建正当法律程序的同时，为提高诉讼效率，节约司法资源，在诉讼的不同阶段都存在着特殊的分流程序，从而分别对侦查、起诉、审判进行不同程度的简化，其中关于审前程序的分流经验尤其对我国目前的分流程序改革有着重要的借鉴意义。
When building due legal processes, there are special diversion programs in various stages of litigation of the Japanese criminal proceedings to improve efficiency and judicial economy. It simplifies the investigation, prosecution, and trial in varying degrees, respectively. Its pretrial diversion procedure can be an important reference for China＇s current diversion program reform.
