病死动物无害化处理监管的法律问题研究

病死动物的无害化处理是关系到生态环境保护、流行病防控、食品卫生安全等多方面的重要社会问题。“黄埔江死猪事件”、福建漳州制售病死猪肉案、辽宁沈阳制售病死鸡案等事件频发，不得不引起人们对病死动物无害化处理监管的反思。从监管的法律规定出发，病死动物无害化处理监管在主体、内容以及法律责任方面都存在问题。因此，病死动物无害化处理监管要落实责任到人，加强部门间的协调合作；对于监管不力的部门，要追究其责任；要加强和完善病死动物无害化处理的配套设施和制度建设。

The harmless disposal of dead animals is an important social problem, related to environmental protection, epidemic prevention and control, food hygiene and safety, and many other important social issues as well. The event of dead pigs on Huangpu River, producing and selling of dead pigs and chickens cases occur frequently, which prompted reflection about the supervision of the harmless disposal of dead animals. It has regulatory problems in the subject, content and legal responsibility, which need to specify the responsibility and strengthen the coordination and cooperation between departments. Accountability mechanisms should be established to investigate the regulatory authorities with inadequate supervision responsibility. At the same time, it needs to strengthen and improve the supporting facilities and system construction.
