摘要
"正当"在诸善冲突中具有的防止不可接受之恶的元价值学功能,不但直接构成了"权益"在人际冲突中具有防止来自他人不可接受伤害的元伦理学功能的基础,而且也间接地影响到"人权"要求在人际冲突中尊重每个人正当权益的规范伦理学内涵。西方哲学忽视了三者之间的微妙异同,导致了某些严重的理论扭曲,尤其是无法有说服力地解释三者在不同层面上具有的普适性意蕴。
The meta- axiological function of'the right'to prevent a person from the unacceptable evil caused in the conflict of various goods not only provides the basis for the meta- ethical function of'rights'to prevent people from the unacceptable harm done by others in the interpersonal conflict,but also influences the normative demand of 'human rights'that everyone's deserved rights should be respected in the interpersonal conflict. Due to overlooking the subtle similarities and differences among them,Western modern political philosophy brings about some gross distortions in theory,and especially fails to explain their universality on different dimensions persuasively.
